This competition (the “Promotion”) is conducted by Nude by Nature Pty Limited ABN: 33140677916 of Governor Phillip Tower Level 29, 1 Farrer Place, Sydney NSW 2000 (the “Promoter”). Entry to the Promotion constitutes acceptance of these Terms and Conditions. By entering the Promotion, entrants accept and acknowledge full responsibility for their decision to participate in the Promotion and to take the Prize if they are the winner. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions. The Promotion is open to anyone from anywhere in the world over 18 years aged 18 years or over. The Promoter reserves the right to request any entrant to provide documentary evidence confirming his/her age. Employees and immediate families of The Hilton Hotels and Resorts, Nude by Nature and their associated companies and agents and the immediate families of such employees are not eligible to enter the Promotion. The Promotion commences at 09:00 (EST) on Thursday 1st September 2016, and ends at 12:00 (EST) on Tuesday 31st January 2017. The Promotion is a game of skill and chance plays no part in determining a winner. Entrance to the Promotion is via the competition website Instagram and requires entrants to submit a photo or video along with an answer to the “Competition Question” – “In 25 words or less, how you are celebrating the holiday Christmas period. All entries must be accompanied by the inclusion of all there social media hastags and handle: #wanderlustbynature #mebynature and @nudebynature plus a # to reference the country where the entrant has taken the photo e.g. #germany. The Competition Question answers will be judged on 50% creativity of the image or video and 50% written expression. The one (1) answer to the Competition Question which is deemed to be both the most creative and most articulate of all valid entries received as judged by the Promoter in its sole discretion will be determined as a winner of a Prize available in the Promotion. Judges’ decision is final and no correspondence will be entered into. An Entrant’s entry must not be, without limitation: a) Late;b) Delayed;c) Incomplete;d) Incomprehensible;e) Unlawful;f) Obscene;g) Defamatory;h) Libellous;i) Threatening;j) Pornographic;k) Harassing;l) Hateful;m) Racially or ethnically offensive;n) Capable of encouraging conduct that would be considered a criminal offence;o) Capable of violating any law; and/orp) Capable of giving rise to civil liability. There is no limit on entries per entrant but each entrant, if deemed a winner, may only be awarded one (1) Prize. PRIZE: One major prize to be awarded to one person for them and one other person also aged 18+. GST). Total international flight costs dependent on origin of flight, dependant on winner location. All prices stated are in Australian dollars, represent the recommended retail price (“RRP”) include GST & are subject to change. Total prize pool valued up to AUD$10000 (incl. GST). The Hilton Hotel and Resort prize offered is subject to availability and black-out dates. The prize is valid for travel until 31 December 2017. Cancellation and change fees apply. Spending money, accommodation (unless included), meals (unless included), additional taxes, insurance, transfers, items of a personal nature, visa’s, inoculations, in-room charges and all other ancillary costs not mentioned in prize inclusions are not included. Prizes are not transferable or exchangeable and cannot be taken as cash. Prizes cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If a prize is obtained through any of these methods, it will not be honoured. Unless expressly stated within these Conditions of Entry regarding the prize, all other expenses become the responsibility of the winner. In the event that for any reason a prize winner does not take the whole or part of a prize within the time stipulated by the Promoter then that whole or part of the prize will be forfeited by the prize winner. If a winner is unable to be contacted or does not claim their Prize within 48 hours of judging, their Prize will be forfeited. The Promoter reserves the right to disqualify any entry or entrant that fails to comply with these Terms and Conditions. If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter reserves the right to close the competition earlier than advertised and the winner will be drawn from entries received to that time.
