The Under 5s Competition Terms & Conditions set out details about participation in Under 5s competitions, competition prizes and how we use, collect and protect any personal information that you give us when you enter any competitions on the Under 5s website www.under5s.co.nz.
Participation in any competitions on the Under 5s website is deemed acceptance of these Terms and Conditions.

1. Who can enter Under 5s competitions
To be eligible to enter Under 5s competitions, entrants must subscribe to the Under 5s newsletter AND be a New Zealand resident.
All other entries will be invalid.
Under 5s' employees and their immediate families, staff employed by businesses advertising on the Under 5s website and agencies associated in anyway with a competition running on the Under 5s website are not eligible to enter.
Under 5s reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Competition Terms and Conditions or who tampers with the entry process.
Failure by Under 5s to enforce any of its rights at any stage does not constitute a waiver of those rights.
2. How to enter Under 5s competitions
To enter any competition on the Under 5s website, entrants must enter their details into the competition entry form on the Under 5s Competitions page, and then submit a fully completed entry form during the competition period.
Under 5s takes no responsibility for late or misdirected entries. Incomplete or indecipherable entries will also be deemed invalid.
Only one entry per person is permitted and any subsequent entries for the same competition(s) will be deleted.
Competitions on the Under 5s website run for 1 month unless otherwise specified.
All entries become the property of Under 5s.
3. Competition prizes
Competition prizes are provided and delivered to the winners by businesses advertising on the Under 5s website, third parties or by Under 5s at their own expense.
Prizes are not transferable or redeemable for cash and no exchanges will be made.
If any prize is unavailable, Under 5s, in its discretion, reserves the right to ask the business running the competition to substitute the prize with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
No correspondence will be entered into.
4. Competition prize winners
Prize winners are drawn randomly by the business running the competition, and where specified, by Under 5s.
The competition winners will be drawn and notified by the businesses offering the competition prizes by email or by phone within 10 working days of the competition closing.
A draw for any unclaimed prizes may take place 10 working days after this date subject to any directions from a regulatory authority.
No correspondence will be entered into.
5. Information we collect from you
Under 5s will only collect personal information relating to you and that you have freely provided to us.
The information we collect from you for the purposes of the competitions that we run on the Under 5s site may include you providing us with your name, address, phone number and email address.
We may also collect and store information from site visitors which is automatically recognised, such as the date and time you visited the Under 5s site, the originating IP address, the type of browser and operating system you used and the URL of the referring page.

6. Disclosure of your personal information
The personal information we collect from you via the Under 5s competition form may be used for a number of purposes. Please see the Under 5s Privacy Policy for full information.
Entry into Under 5s competitions is conditional on you providing the personal information required and subscribing to the Under 5s e-newsletters.
By entering Under 5s competitions you freely submit your personal information on the Under 5s competitions form which will be entered into and stored in the Under 5s database.
Your competition entry form will be kept on file for a minimum of 5 days before your details are transferred to the Under 5s database to use for future promotions, e-newsletters and other communications.
Under 5s and the businesses running the competitions and providing the competition prizes may, for an indefinite period unless otherwise advised, use the personal information you have provided to send you information about their business, marketing and promotional material and other information they think will be of interest to you. This includes sending emails or telephoning competition entrants.
Under 5s and businesses running competitions with us may also publish your details on their social media channels announcing that you are the winner of their competition prize(s).
You can unsubscribe from the database at any time by emailing your details to unsubscribe@under5s.co.nz.
7. Updating your personal information
As an Under 5s competition entrant you have the right to ask for a copy of any personal information that Under 5s holds about you, and to ask for it to be corrected if you think it is wrong.
If you would like a copy of the information we are holding about you or believe that any information we are holding about you is incorrect or incomplete, please email us at info@under5s.co.nz as soon as possible so that we can pass on the information or update your details.
8. Liability
Except for any liability that cannot be excluded by law, Under 5s (including its employees and agencies) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under Under 5’s control)
(b) any theft, unauthorised access or third party interference
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Under 5s or the business running the competition) due to any reason beyond the reasonable control of Under 5s
(d) any variation in the prize that is stated on the Under 5s competition page
(e) any tax liability incurred by a winner or entrant or
(f) use of a prize.
9. Updating this policy
At Under 5s Limited we may review and/or change the Under 5s Competition Terms & Conditions from time to time by updating our Competition Terms & Conditions page on the Under 5s website.
Once the Under 5s Competition Terms & Conditions page is changed, your ongoing use of the Under 5s website www.under5s.co.nz and entering competitions on the Under 5s site indicates your acceptance of these changes.
