Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The Promoters are Glaxosmithkline Consumer Healthcare New Zealand Limited of Level 11, Zurich House, 21 Queen Street, Auckland 1010, New Zealand (“Glaxosmithkline”) and Progressive Enterprises of 80 Favona Road, Favona, Auckland 2024, New Zealand (“Countdown”)
Entry is only open New Zealand residents aged 18 years or over who have a Countdown Onecard. Employees (and their immediate families) of Glaxosmithkline and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 29/05/2017 and final entries close at 11:59pm local time on 25/06/2017 (“Promotional Period”).
By entering into this promotion you agree to be bound by these Terms and Conditions and acknowledge that you have complied with all of your obligations under the Onecard terms and conditions. The Promoters reserve the right to deem that your entry is void should you fail to comply with any of these terms and conditions.
To enter and receive one (1) automatic entry into the draw, individuals must purchase in a single transaction, any two Macleans products from any Countdown supermarket nationally, using their Countdown Onecard at the time of making the transaction (either online or at the checkout), during the Promotional Period (each a “Qualifying Transaction”). For online Qualifying Transactions, the delivery must be within the Promotional Period. For the avoidance of doubt, customers will not be eligible to participate in this promotion if they do not swipe or enter their Onecard details at the time of purchase. Entries will not be accepted on a retrospective basis after the time of purchase.
The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserve the right, in their sole discretion, to disqualify any individual who they have reason to believe have breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction regardless of the number of Macleans products purchased in that transaction; and (b) each Qualifying Transaction must be made separately and in accordance with entry requirements.
If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the entrant.
The draw will take place at Countdown Support Office, 80 Favona Road, Favona, Auckland 2024 at 10:00am local time on 27/06/2017. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by telephone, email or mail using the details listed on the OneCard database. Entrants should ensure that their personal details on the OneCard database are correct. Details can be updated via the website www.countdown.co.nz/onecard or by phoning the Countdown Customer Care team on 0800 40 40 40. In the event the winner cannot be contacted within three (3) weeks of the prize draw, the prize will be re-drawn.
The drawn winner’s details will be posted on the Countdown website for three (3) weeks following the draw date. The winners can be viewed atwww.countdown/onecard/onecard-competitions.
The Promoter’s decision is final and no correspondence will be entered into.
The first four (4) valid entries drawn will each win a trip for two (2) adults and two (2) children (11 years or under) or one (1) adult and three (3) children (11 years or under) to see The Wiggles perform in Auckland scheduled to take place on 15th July 2017 (subject to change) valued at up to a maximum of $5,500 depending on point of departure. Prize includes:
Four (4) return economy airfares from winner's nearest New Zealand airport to Auckland, New Zealand (only provided if winner resides outside of Auckland). If a winner is from Auckland, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash;
Two (2) nights quad share minimum 4star accommodation in Auckland, New Zealand;
Return airport to hotel transfers (if necessary);
Family admission to The Wiggles Concert in Auckland scheduled to take place on 15th July 2017 including a Meet & Greet. The exact date is yet to be confirmed and is subject to change;
Return hotel to concert transfers; and
NZ$1,000 spending money (for the winner only).
Additional spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Airline travel, airport transfers and accommodation are subject to the relevant supplier’s standard terms and conditions and the Promoter will not be liable for any act or omission of any third party providing those services.
Prize must be taken to coincide with the Wiggles concert event with flights departing on 14th July 2017 (date subject to change at Promoters’ discretion and or due to The Wiggles scheduling changes) and is subject to booking and flight availability. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. Winners and their companion/s must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoters in their absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winners may be required to present their credit card at time of accommodation check in.
The Prize is not transferable, redeemable and may not be exchanged for cash. If for any reason a winner does not take the prize (or an element of the prize) at the time stipulated by the Promoters, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, state of emergency or disaster, the Promoters reserve the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
If any prize (or part of any prize) is unavailable, the Promoters, in their discretion, reserve the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The Wiggles concert ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoters and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
The “Meet & Greet” element awarded as part of the prize provides the winners (and their companion/s) with an opportunity to meet one or more members of The Wiggles, and an opportunity to have a photograph taken with them. This element of the prize is not guaranteed and is subject to the goodwill of The Wiggles on the day. The Promoters accept no responsibility and will not offer any alternative in the event that this element of the prize cannot be offered for any reason.
Total prize pool value is up to NZ$22,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
Entrants consent to the Promoters using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.Entrants further acknowledge that children may be present for such recording of photograph, film or otherwise and that such content may be used for promotional purposes for the benefit of the Promoters. Winners acknowledge that as a condition of accepting the Prize they as a parent or guardian consent to such material being taken, stored and used by the Promoters and will do all things reasonably required by the Promoters to enable the Promoters to do so. Where a Winner is not a parent or guardian of an accompanying child, they agree to do all things necessary to obtain appropriate consents from the child’s parent or guardian, as a condition of the child partaking in the Prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if The Wiggles concert is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoters; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize/attendance at the prize event.
As a condition of accepting the prize, the winner (and /their companion/s) must sign any legal documentation as and in the form required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
The Promoters collect and require your personal information in order to conduct the promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the promotion. By entering this promotion, each entrant is taken to consent to the Promoters using the entrant’s personal information to administer the promotion, announce the winner and the Promoters may, for this purpose, disclose the entrant’s personal information to organisations that assist the Promoters with administering the promotion and announcing the winner, and if required, to other third parties, including but not limited to agents, contractors, service providers and prize suppliers and as required by law (including authorities that regulate this promotion). The Promoters may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing and publicity purposes, including sending electronic messages or telephoning the entrant. The Promoters are bound by the National Privacy Principles in the Privacy Act 1993 and by entering the promotion, the entrant is taken to consent to each Promoter’s privacy policy. Entrants should direct any request to access, update or correct information to the Promoters. All entries become the property of the Promoters.
These terms and conditions are governed by the laws of New Zealand.
