Terms and conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia and New Zealand. Entrants under the age of 18 years must have prior parental or legal guardian consent to enter, and further, the parent/guardian of the Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion. Employees (and immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.
3. The Promotion commences on 10 July 2017 and closes at 11:59pm AEDT (for online entries) or last mail received on 22 January 2018 ("Promotional Period").
4. The Promoter's decision is final and no correspondence will be entered into.
5. To be eligible to enter, individuals must purchase any Puzzler branded puzzle magazine during the Promotional Period that features the Win A Car promotional logo ("Participating Titles"). For the sake of clarity, any Puzzler branded puzzle magazine that does not feature the Win A Car promotional logo will be deemed invalid for entry into this Promotion.
6. To enter, individuals must then complete one (1) of the following entry methods during the Promotional Period:
Mail Entry: To enter via mail individuals must, with the coupon found inside the Participating Title, complete at least one (1) puzzle in the Participating Title (purchased in accordance with clause 5 above), write the name of the puzzle completed and the correct solution to that puzzle in the space provided on the official entry form (found within that Participating Title), complete the rest of the official entry form with all of the requested personal details (including their full name, mailing address and daytime telephone number), and then send the fully completed entry form to "Puzzler Win A Car Competition, GPO Box 2462, Sydney, NSW 2001, AU" (for Australian residents) or to "Puzzler Win A Car Competition, Private Bag 92-217, Auckland Mail Centre, Auckland, NZ" (for New Zealand residents) so that it is received during the Promotional Period ("Mail Entry").
Online Entry: To enter online individuals must complete at least one (1) puzzle in the Participating Title (purchased in accordance with clause 5 above) then visit the promotional entry page at www.puzzler.com.au/competitions (in Australia) or www.puzzler.co.nz/competitions (in New Zealand), write the correct answer of the puzzle completed as prompted, and submit the online form with their personal details fully completed (including their full name, address, a valid email address and daytime telephone number) so that it is received during the Promotional Period ("Online Entry").
7. Multiple entries are permitted, subject to the following: (a) a maximum of two (2) entries are permitted per Participating Title purchased, being a maximum of one (1) entry via mail and a maximum of one (1) entry online; and (b) each entry must be submitted separately and in accordance with the entry instructions outlined above. Each Mail Entry must be posted in a separate stamped envelope and contain an official entry form with a correct promotional puzzle solution. Each Online Entry must be submitted separately online with a fully completed online form with a correct promotional puzzle solution.
8. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
9. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Original copies of entries will not be returned to the Entrant after the draw has been completed.
10. Incomplete, indecipherable, incorrect or illegible entries will be deemed invalid.
11. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process, or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
12. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
13. There will be one (1) draw conducted for all entries received during the Promotional Period. The draw will take place on 24 January 2018 at Direct Response Australia, Unit D, 65 Reserve Road, Artarmon, NSW 2064 at 10:00am (AEDT). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible Entrant is drawn.
14. The Winner will be notified in writing and by telephone within two (2) business days of the draw and their name will be published online at www.puzzler.com.au and www.puzzler.co.nz, and in The Australian from 31 January 2018.
15. The first drawn valid entry (from all valid entries received) will win the following prize, as applicable to their country of residence:
Australian Resident: A 17MY Mirage ES with automatic transmission valued at up to AU$16,293 including ‘On Road Costs’ (on road costs vary dependent on State/Territory of residence).
New Zealand Resident: A white Mirage XLS with automatic transmission valued at up to NZ$20,440 including ‘On Road Costs’ (on road costs may vary).
16. Total prize pool in Australia is valued at up to AU$16,293. Total prize pool in New Zealand is valued at up to NZ$20,440.
17. In the event that the Winner is under the age of 18 years, the prize will be awarded to the Winner’s parent or legal guardian on behalf of the Winner. Furthermore, the Winner must be accompanied by their parent and/or legal guardian when redeeming their prize. It is the responsibility of the Winner’s parent/legal guardian to prove their parental status/legal guardianship at the time of Winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a Winner’s parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to any administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the Winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the Winner and their respective parent/s and/or legal guardian/s.
18. If necessary, an unclaimed prize draw may be held on 24 April 2018 at 10:00am (AEST) at Direct Response Australia, Unit D, 65 Reserve Road, Artarmon, NSW 2064, in order to distribute the prize, if unclaimed, subject to any directions from a regulatory authority. The Winner, if any, will be notified by telephone and in writing within two (2) business days of the draw and their name will be published online at www.puzzler.com.au and www.puzzler.co.nz, and in The Australian from 27 April 2018.
19. Prize must be taken as offered. The prize is not transferable or exchangeable and cannot be redeemed as cash unless otherwise specified. The Promoter accepts no responsibility for any variation in the prize value. The prize Winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of the prize. The prize must be taken as offered. Prize includes standard fittings, registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Any ancillary costs associated with redeeming this prize are the responsibility of the Winner. All optional extras and accessories, comprehensive insurance and any other insurance not stated as included in the prize, fuel, personal costs and any other ancillary costs associated with redeeming the prize are excluded and are the responsibility of the Winner.
20. The Winner must have a current valid Australian or New Zealand driver’s license, as applicable. If the Winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then such Winner may assign the motor vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the Winner and the assignee. The Winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the Winner (or the Winner’s parent/legal guardian if the Winner is under the age of 18, in accordance with clause 17 above) may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
21. The vehicle prize excludes any optional extras. Subject to agreement by the supplying dealer, stock availability and subject to the Winner agreeing to pay any additional amount requested by the dealer, the Winner may upgrade the vehicle optional extras, colours (including metallic options) and accessories. Except as expressly stated in these Terms and Conditions, the supplying dealer will not provide a substitute model. The supplying dealer will not exchange the vehicle for cash.
22. The Winner will not be able to select the vehicle colour or transmission type; this will be determined by the Promoter as outlined above in clause 15.
23. The Promoter takes no responsibility for any mechanical, body or paint repairs from the date and time of delivery.
24. Unless expressly stated within these Terms and Conditions, all expenses incurred in relation to the vehicle prize (including insurance) are the responsibility of the Winner.
25. Prize values are correct at time of printing/submission; no responsibility is accepted for any variation in the value of the prize.
26. The prize supplier is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
27. The Winner must provide all information and sign all documentation necessary to enable Mitsubishi Motors Australia Limited to register the prize in the Winner's name prior to collection. Receipt of the prize is subject to the Winner being able to lawfully take possession of the prize and comply with all registration and compulsory third party insurance requirements of the State/Territory in which the Winner elects to register the prize.
28. The Winner of the prize must collect it from the nominated dealer and it must be registered prior to collection. Any number plate details used in the promotion of the competition are representational only. If the Winner is unable to collect the vehicle, the Winner may incur the cost of transporting the vehicle, if needed, from their nearest dealership to an alternate prize claim point as nominated by the Winner and deemed acceptable by the Promoter. Any costs associated with the transport of the vehicle to an alternate location will be the responsibility of the Winner.
29. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the Winner.
30. It is a condition of winning that the prize Winner provides the Promoter with their full name, address, and a copy of their current Australian or New Zealand driver’s license (as applicable) prior to the awarding of the prize.
31. Prize is subject to the standard terms and conditions of Mitsubishi Motors Australia Limited.
32. Subject to the unclaimed prize draw clause, in the event that for any reason whatsoever the Winner does not take the prize, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
33. In the event that the prize is unavailable, the Promoter reserves the right to substitute the prize, in its discretion, with an alternative prize to the same and equal recommended retail value and/or specification subject to any written directions from the various lottery departments.
34. The Promoter is neither responsible nor liable for any late, lost or misdirected mail (including but not limited to the prize).
35. The Promoter is neither responsible nor liable for any prize damaged in transit in the delivery of the prize.
36. Any cost associated with accessing the promotional website or posting any entries via mail is the Entrant’s responsibility and is dependent on the Internet Service Provider or mailing company used and postage option selected.
37. If your entry is selected as a winning entry, validation of your circumstances/the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the Winner will be notified as per the Terms and Conditions herein. In the event that the Promoter requests the Entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize that the Winner signs any such legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event that the Winner is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
38. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
39. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
40. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or Entrant; or (f) taking/use of a prize.
41. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Privacy
42. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. The Promoter may also disclose PI to other third parties, who may send the Entrant promotional and marketing communications, unless the Entrant ticks the box on the entry form stating "Please do not provide information about me to any organisation not associated with this competition". Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be accessed by visiting www.puzzler.com.au/legals/privacy-policy (for Australian residents) or www.puzzler.co.nz/legals/privacy-policy (for New Zealand residents). In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entries collected in Australia will not be disclosed overseas.

The prize supplier is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
27. The Winner must provide all information and sign all documentation necessary to enable Mitsubishi Motors Australia Limited to register the prize in the Winner's name prior to collection. Receipt of the prize is subject to the Winner being able to lawfully take possession of the prize and comply with all registration and compulsory third party insurance requirements of the State/Territory in which the Winner elects to register the prize.
28. The Winner of the prize must collect it from the nominated dealer and it must be registered prior to collection. Any number plate details used in the promotion of the competition are representational only. If the Winner is unable to collect the vehicle, the Winner may incur the cost of transporting the vehicle, if needed, from their nearest dealership to an alternate prize claim point as nominated by the Winner and deemed acceptable by the Promoter. Any costs associated with the transport of the vehicle to an alternate location will be the responsibility of the Winner.
29. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the Winner.
30. It is a condition of winning that the prize Winner provides the Promoter with their full name, address, and a copy of their current Australian or New Zealand driver’s license (as applicable) prior to the awarding of the prize.
31. Prize is subject to the standard terms and conditions of Mitsubishi Motors Australia Limited.
32. Subject to the unclaimed prize draw clause, in the event that for any reason whatsoever the Winner does not take the prize, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
33. In the event that the prize is unavailable, the Promoter reserves the right to substitute the prize, in its discretion, with an alternative prize to the same and equal recommended retail value and/or specification subject to any written directions from the various lottery departments.
34. The Promoter is neither responsible nor liable for any late, lost or misdirected mail (including but not limited to the prize).
35. The Promoter is neither responsible nor liable for any prize damaged in transit in the delivery of the prize.
36. Any cost associated with accessing the promotional website or posting any entries via mail is the Entrant’s responsibility and is dependent on the Internet Service Provider or mailing company used and postage option selected.
37. If your entry is selected as a winning entry, validation of your circumstances/the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the Winner will be notified as per the Terms and Conditions herein. In the event that the Promoter requests the Entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize that the Winner signs any such legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event that the Winner is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
38. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
39. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
40. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or Entrant; or (f) taking/use of a prize.
41. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Privacy
42. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. The Promoter may also disclose PI to other third parties, who may send the Entrant promotional and marketing communications, unless the Entrant ticks the box on the entry form stating "Please do not provide information about me to any organisation not associated with this competition". Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be accessed by visiting www.puzzler.com.au/legals/privacy-policy (for Australian residents) or www.puzzler.co.nz/legals/privacy-policy (for New Zealand residents). In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entries collected in Australia will not be disclosed overseas.
